Westhaven Parking Ticket....

On Tuesday morning I got pinged for $65 by Wilsons while parked at Westhaven. I appealed this on the following basis (all of which is entirely true):

 

"On Tuesday 5th September 2017 I was parked in Westhaven in a white space opposite the entrance to P-Pier. My purpose in being there was to assist the owner of the boat “Close Encounters” (berth P59 – ****** contact 021*******) in the setup and testing of a new gennaker sail. This operation should have taken only an hour or so. However, due to complications in setup and the particularly light winds on the Waitemata harbour that morning this took rather longer than anticipated. If we had known beforehand this was going to take so long, we would, of course, have requested a temporary pass for my car which I would have been entitled to. I hope you can see fit to waive this fee considering the unusual weather and issues we were having that morning and the fact that I would have been entitled to remain parked there had we been able to foresee these circumstances.

Today I got the following:

 

"Thank you for your recent communication regarding the above Breach Notice. 

After careful consideration of the evidence, we can confirm that it was issued in accordance with our procedures and the Terms and Conditions of parking, which are displayed on the Important Notice and signage at this car park.
 
The vehicle was parked in excess of the maximum (sign-posted) time allowed and was in breach of the Terms and Conditions, therefore, the Breach Notice will stand."
 
Thoughts? Fair cop, my fault, take it on the chin? Or are Wilson's faceless corporate bas***ds, lacking in humanity and screwing us all for every penny?

Your latter option describes Wilsons perfectly...leeches and parasites ! Probably hiding in the bushes waiting for  time to be up.

Wilsons = arseholes

 

There was something in the telly not too long ago about Wilsons and situations like this. Can't quite remember what it was but someone did have a way to piss them around to the point it cost them a lot of money. I'm thinking Fair Go....maybe there is a on demand thing you can find it on. I do remember thinking 'Cool, I'll use that next time the wankers ping me'.

I guess the moral is, get a parking pass even if you are only gonna be 5 mins in case something unforeseen happens.

I would have thought they could have let you off this time, and forewarned you that next time you wouldn't be so lucky.

Here you go.. as KM said I remember reading something as well....

Let's consult the Ministry of Consumer Affairs. Under contract law, parking companies can only claim for "the actual and reasonable costs they incurred". Charging $65 for a short overstay in an empty carpark is as far from reasonable as you can get.

Here's what to do in this situation. Work out how much you actually owe – in the example above, 10c is the fair amount. Remember the operator also has admin costs for issuing tickets, so you could round that up to a few dollars. Write out a cheque, or make the payment by internet banking, then send them this letter.

Dear Parking Company,

I was four minutes late in returning to my car due to [Your Reason Here].

I have made payment of $5 to cover my transgression.

As you will be aware, by law you are only allowed to charge for the actual and reasonable loss suffered by my overstaying, rather than impose any sort of penalty.

I therefore consider this matter settled in full.

With population growth and commercial development, Westhaven is now very much an inner city marina.
It was purchased by Auckland Council in 2010 so that the public space could be returned to the people of Auckland for recreation and enjoyment by the sea.

What part public enjoyment do they get handing out parking tickets on a weekday?yes I presume they get a lot city workers trying to park for free,but From above it seems a reasonable explanation and surely a warning is all that is needed.

have tried and failed to get various passes from the office for crewing on overnight sailing races

 

fortunately haven't been pinged yet...

 

afaik

 

they were in the news recently for handing out tickets on council owned streets outside parking buildings on the assumption that they could and doing so cost them nothing\

 

goff's starting to realise how expensive the new council social responsibilities are 

 

(te reo in lifts, bus stops etc)

 

and as he feels he has a mandate to 'eat the rich'

 

why not start with westhaven parking

 

after all the poor of pukekohe can only afford so many fines for parking on their empty berms at 2am

Every story I read like this one just reminds me why I will never live in Auckland again.

Funny, I can think of a few marinas that aren't under socialist ownership and that people somehow manage to enjoy just fine.

Thats just PR crap to make people feel good, Westhaven is a money printing machine, they blather on that they only make 6 or 8% on their "investment" but what did it cost in the first place? Nothing socialist about the marina, more mercenary! The council have been hell bent on monetising it and the surrounding land, but thanks to the Westhaven marina users association it has been rezoned.

 

The parking enforcement is in place because greedy little aucklanders have been using it as a free parking spot while going to work. Bigger picture = sh*t transport and roading, bad town planning. Cant really blame either party but the rules are useless because who can tell if you're a sailor or a freeloader? Ive been pinged but since Im a berth holder I got off after two letters. I hate parking enforcement companies with a passion, towing and wheel clamping are literally daylight robbery.

 

Best thing is to start writing letters, call up the marina, council etc, make noise and start complaining long and loud.
