Westhaven Parking Ticket....

On Tuesday morning I got pinged for $65 by Wilsons while parked at Westhaven. I appealed this on the following basis (all of which is entirely true):

 

"On Tuesday 5th September 2017 I was parked in Westhaven in a white space opposite the entrance to P-Pier. My purpose in being there was to assist the owner of the boat “Close Encounters” (berth P59 – ****** contact 021*******) in the setup and testing of a new gennaker sail. This operation should have taken only an hour or so. However, due to complications in setup and the particularly light winds on the Waitemata harbour that morning this took rather longer than anticipated. If we had known beforehand this was going to take so long, we would, of course, have requested a temporary pass for my car which I would have been entitled to. I hope you can see fit to waive this fee considering the unusual weather and issues we were having that morning and the fact that I would have been entitled to remain parked there had we been able to foresee these circumstances.

Today I got the following:

 

"Thank you for your recent communication regarding the above Breach Notice. 

After careful consideration of the evidence, we can confirm that it was issued in accordance with our procedures and the Terms and Conditions of parking, which are displayed on the Important Notice and signage at this car park.
 
The vehicle was parked in excess of the maximum (sign-posted) time allowed and was in breach of the Terms and Conditions, therefore, the Breach Notice will stand."
 
Thoughts? Fair cop, my fault, take it on the chin? Or are Wilson's faceless corporate bas***ds, lacking in humanity and screwing us all for every penny?

I guess the moral is, get a parking pass even if you are only gonna be 5 mins in case something unforeseen happens.

I would have thought they could have let you off this time, and forewarned you that next time you wouldn't be so lucky.

With population growth and commercial development, Westhaven is now very much an inner city marina.
It was purchased by Auckland Council in 2010 so that the public space could be returned to the people of Auckland for recreation and enjoyment by the sea.

What part public enjoyment do they get handing out parking tickets on a weekday?yes I presume they get a lot city workers trying to park for free,but From above it seems a reasonable explanation and surely a warning is all that is needed.

have tried and failed to get various passes from the office for crewing on overnight sailing races

 

fortunately haven't been pinged yet...

 

afaik

 

they were in the news recently for handing out tickets on council owned streets outside parking buildings on the assumption that they could and doing so cost them nothing\

 

goff's starting to realise how expensive the new council social responsibilities are 

 

(te reo in lifts, bus stops etc)

 

and as he feels he has a mandate to 'eat the rich'

 

why not start with westhaven parking

 

after all the poor of pukekohe can only afford so many fines for parking on their empty berms at 2am

Every story I read like this one just reminds me why I will never live in Auckland again.

Funny, I can think of a few marinas that aren't under socialist ownership and that people somehow manage to enjoy just fine.

5 or more years ago there was no problem and no time limits.  You could park in the white bays all day any day.  But they were mostly empty during the week.

 

But then the big corporates (Vodaphone, AirNZ) have decided that they must have their offices in the marine precinct, the office workers started parking in the white bays, and it become a problem.  So the marina imposed time limits, and started fining, which is good cause we want to keep the car parks free for sailors.  However some sailors are getting fined which is a problem.

Interestingly, Auckland Transport (Akl City Council) are moving into the Vodafone building shortly hence I wonder where their staff are parking?!.

An electrical contractor and friend was installing some equipment on mine the week before Christmas last , he got the same thing mid week no one about, when I kicked up at Westhaven they shrugged their shoulders and said something along the lines of out of our hands its Wilson. Which I feel was a miserable gutless cop out he was 5 mins over the alloted time to shift . By the way there is one patrolling the parks everyday this week, so be warned - and fellow marina tenants stamp your feet and demand the temp tickets for anyone working on your boat, they have been offered, and just because the girl is new to the office she cant deny this.

Have just been down southland where there are virtually no rules i feel the further north you go the more your freedom is taken away.For example if you want a mooring in southland you just put one down anywhere even stewart island no resource consent nothing.Auckland sounds like a terrible place to live I like to visit but no way in hell would I live there.

Seems the second appeal was worth while - ticket waived :-)

Re: Parking Breach Notice 755574645 Registration AYJ262 

Thank you for your recent communication regarding the above Breach Notice. 

After careful consideration of the evidence, we can confirm that it was issued in accordance with our procedures and the Terms and Conditions of parking which are displayed on the Important Notice and signage at this car park.

However, the good news is, we can confirm that the Breach Notice has been waived on this occasion.

Please make sure in the future that you comply with the Terms and Conditions, as any further Breach Notices under these circumstances
wont will not be waived.

I posted about this ages ago. They have no legal right to impose fines. They can only charge you for their loss, which is zero. I wrote to them, pointed this out and then threw it in the bin.

Well done, you must have written a very good email!

 

Not so much a good email more just sticking to my guns: 

 

"While I understand the need for enforcement in the Westhaven car parks I do not accept the outcome of this appeal. As I stated in the reason for the first appeal I was entitled to be parked in that spot. I was on the marina as a guest of a berth holder and if we had anticipated the problems we were to have we would have been entitled to a pass from the marina office. This is simply a case of oversight in procedure and not in anyway an attempt to park in breach of the terms. Yours Neil Lawton."
