I was told 2 weeks ago that's why the exclusion zone is there, to stop terrorists. I wonder if they told the French Government that?

 

I did suggest that Auckland Super Shitty should send a delegation to see Trump and stop him building that wall. If the Council can stop terrorists simply by screwing a few very hard to both see and read 1/2 arsed signs up, then why does Trump need to spend billions.

The appeal is on.

Gearing up for Round 3... or 4, lost count there are so many going on.

 

Does anyone have any computer graphic skills? I'd like to make a small animation of the alternative proposal we put forward. I'm of the thought a graphical demonstration would convey the suggestion far better than just voice. I did get asked a lot of clarification type questions by the commissionaires I think a graphic would better explain.

 

It's nothing big or flash, just a cartoon like thing (not knowing the right words) would do it.

 

Or maybe one of those moving .gifs if anyone can aim me at any sort of 'Moving .GIFs for Dummies' type place.

 

We're pretty sure now we have discovered paperwork that shows the suggested 15mill is more likely to end up over 30mill, if we can get across our suggested alternative, which I'll have fully costed (around 10 mill, 15 by the time you get RC :twisted:  hopefully less) it should make them take serious notice.

 

The proposed alternative gives every party what they want and does it for less cost, less environmental damage and less removal costs.

 KM..MB I'm under the impression with an appeal you can not offer new evidence. You can only appeal but I'm not a lawyer regarding  the Judges decision was it faulty based on the evidence he had before him or that he over looked some technical legal point, the filed paper work procedure was incorrect, not the contents. The time to challenge their proposal was at the hearing and their proposal was granted to proceed. If your proposal was flawed / deficient you can not use that as grounds to try, resubmit evidence to get the appeal court to over turn a judges decision. Loose and you will have pay all the councils lawyer costs fees, they can ask for that over above awarded court costs, plus court costs, Got a spare $500,000 dollars have you. Can you see your way clear to shout me a trip to Hawaii for 10 days or more.  :wave:  :roll:  :idea:  :-D

This is in the Environment Court. You appear to be getting mixed up with either the Criminal Court, or Civil legal proceedings.

Shouldn't make any difference. The public could appeal the AC decision then on the grounds of the dredging's that would be dumped at great barrier Island being an environmental Disaster waiting to happen. Any dredging's for the Dolphin moorings erection having to be dumped some where?  :idea:  :wave:

Trust me, there are far smarter people than KM involved in this (no offence KM).

Even among professional bodies, there is a lack of understanding of the RMA process, planning rules and how the Environment Court works.

Giving advice on areas beyond you knowledge, especially matters of law, risk and consequences, can lead to, how do we say? adverse outcomes.

KM's specialist knowledge in all of this is around how to tie up ships (i.e. rope and stuff). It is my understanding that the decision to lodge an appeal has been taken by people with specialist knowledge in that area, and informed by suitably experienced environmental lawyers. This is all several levels above "internet experts"...

You're both wrong, one about the Environment court not quite there yet as I understand it but it is in play somehow, the other about many aspects. I am all a tad confused, as many seem tom be hence why so many lawyers are in it all. Rest assured this is being done by the rules, you have no option but to do that as we have the whole council organisation more than happy to spend what they need to to shut down any discontent. They do use the treat of costs a LOT and that does allow the council to subvert the democratic process and ratepayers desires. But we are aware of that so will be doing what we need to when we need to.
 
It's a simple case of Live on your feet or you get on your knees lips lubed like the limp subservient bitch you made yourself.....and the council tries hard to make you.

Probably insurance but then doesn't Akl Super Shitty do a some self-insurance in which case the usual suckers will pay i.e. the ratepayers.
 
Knocking over dolphins is not uncommon. Those ones in the video must be very weak to fall over like that.

As you are right, an unusual occurrence but can happen ;), no offence taken.

I'm only there are a technical expert on things mooring, certainly not things legal. That's why the 10's of 1000's are being spend on lawyers.

No need to point at Spain, you can point at Auckland, Akaroa and Port Charmers for the same thing both have expressed concerns about pollution supported by facts. I think there is one or 2 others in NZ as well.

Rehab, No AC boats or AC marina will ever berth at the subject of this thread, take that AC stuff elsewhere please.
