No. you are not required to give room at a start mark or a finish mark...

 

I don't know which rule book you read but the rules clearly state no room at a start mark but by gum there is at a finish mark. cutting from the rule book.

 

SECTION C

AT MARKS AND OBSTRUCTIONS

Section C rules do not apply at a starting mark surrounded by navigable

water or at its anchor line from the time boats are approaching

them to start until they have passed them. When rule 20 applies,

rules 18 and 19 do not.

There is another situation...

 

If you come in from behind and to leeward of another boat during prestart you may luff him in a controlled manner up to head to wind (give room and opportunity etc etc) as there is no proper course before the start. However as soon as the start gun goes you are not entitled to sail above your proper course so you may have to bear away to a closehauled course which may effectively give the windward boat room for the mark/committee boat.

 

However if the overlap was initially created by the other boat coming in from behind and to windward... go for gold ! Full luffing rights but just give room and opportunity for them to keep clear.

This assumes the first leg is an upwind leg. If it is not an upwind leg the "to a closehauled course" bit needs to be changed to "to a proper course".
