Thanks, I hadn't seen that, though it's not clear to me how Section 200AB of the Copyright Act they refer to there gives them an out. Unless they're saying ((1)(d)) "the use does not unreasonably prejudice the legitimate interests of the owner of the copyright"... because he's dead!

Difficult to see how that would be legit. I was incredibly sad to read this news today, Sandra Tartaglino, a well-known US cat sailor was killed in an accident this past weekend on Narragansett Bay while competing in the New England 100. Yes, it was a two-sided affair alright. The port side bow of an NZL windward boat was sailed into the starboard side of a SUI leeward boat in 15-20kt of breeze. If I was the SUI sailor I'd be a little exercised as well.
